Termeterai Sudah Perjanjian Penyelesaian Komersil Antara Sarawak, Petronas - Satu Lagi Kejayaan Kerajaan GPS


KUALA LUMPUR: Termeterai sudah perjanjian bersejarah antara Kerajaan Sarawak dan PETRONAS melalui Perjanjian Penyelesaian Komersil (CSA) yang ditandatangani di Ibu Negara antara kedua-kedua pihak pagi ini.

Kerajaan Sarawak diwakili Setiausaha Kerajaan Sarawak, Datuk Amar Jaul Samion sementara PETRONAS oleh Presiden dan Ketua Pegawai Eksekutif PETRONAS, Tengku Muhammad Taufik. 

Perdana Menteri, Tan Sri Muhyiddin Haji Yassin dan Ketua Menteri, Datuk Patinggi Abang Haji Johari Tun Abang Haji Openg hadir untuk menyaksikan upacara tersebut.

Terdahulu Timbalan Ketua Menteri, Datuk Amar Haji Awang Tengah Ali Hassan yang mengetuai tim perundingan Negeri Sarawak berucap mewakili Kerajaan Sarawak.

Perjanjian tersebut antara lain menyaksikan Sarawak mempunyai hak eksklusif beradasarkan OMO 1958 bagi operasi di daratan dan penglibatan ekuiti melalui PSC bagi aktiviti-aktiviti luar pantai Sarawak.

Ladies and Gentlemen.

Salam Sarawakku Sayang,

1. Hari ini merupakan hari yang sangat bersejarah iaitu Majlis Menandatangani Perjanjian Penyelesaian Komersial dalam sektor minyak dan gas di antara Sarawak dan Petroliam Nasional Berhad (PETRONAS).  Perjanjian ini dibuat berdasarkan pemahaman, penghormatan dan semangat untuk bekerjasama demi untuk kepentingan bersama dalam sumber minyak dan gas.   Perjanjian ini juga diharap akan dapat memastikan pembangunan yang berterusan dalam industri minyak dan gas untuk kepentingan semua stakeholders termasuk Negeri Sarawak dan negara kita Malaysia.

2. Bagi pihak Yang Amat Berhormat Ketua Menteri Sarawak, Kerajaan Negeri dan seluruh rakyat Sarawak, saya ingin mengucapkan setinggi-tinggi penghargaan dan terima kasih kepada YAB Tan Sri Muhyiddin bin Yassin, Perdana Menteri Malaysia atas komitmen, bimbingan dan sokongan beliau sehingga kita dapat mencapai Penyelesaian Komersial pada hari ini.  Saya juga ingin mengucapkan ribuan terima kasih kepada Yang Amat Berhormat Perdana Menteri yang telah memainkan peranan dalam penyelesaian isu State Sales Tax (SST) dengan PETRONAS baru-baru ini.   Terima kasih juga kepada PETRONAS yang telah menyelesaikan pembayaran SST ini without going through legal process.   Ini menunjukkan bahawa Yang Amat Berhormat Perdana Menteri amat faham tentang aspirasi rakyat Sarawak untuk mendapatkan bahagian pendapatan yang lebih adil dari hasil minyak dan gas yang dihasilkan di Sarawak.

3. Di kesempatan ini juga, saya ingin mengucapkan jutaan terima kasih kepada Yang Amat Berhormat Ketua Menteri Sarawak atas bimbingan, sokongan dan inspirasi yang tidak ternilai bagi saya dan ahli pasukan Kerajaan Negeri Sarawak yang lain untuk berunding dan mencari jalan bagi Penyelesaian Komersial ini.

Distinguished Guests, Ladies and Gentlemen,

4. Oil mining in Sarawak began in 1910 in Miri, Sarawak. Prior to the formation of Malaysia, Sarawak already had laws regulating oil mining on land and offshore in the Continental Shelf. The State had also been receiving revenues in the form of oil royalty and petroleum tax before 16 September, 1963.

5. Mining in the offshore areas started in the 1970s. Today, Sarawak accounts for over 60% of the national natural gas production and over 25% of the nation’s oil output. One of the world’s biggest liquefied natural gas complex is located at Bintulu which manufacture 28 million tonnes of LNG per annum.

6. On account of these factors, the aspirations of Sarawakians are for the State Government to:-

a. have a greater degree of involvement in the management of our oil and gas resources on both onshore and offshore areas,

b. enjoy a more equitable share of the revenues from these resources,

c. be accorded with greater investment opportunities for the State in both the upstream and downstream sectors,

d. secure availability of natural gas produced in the State at fair prices to boost the State’s industrial development agenda, and

e. for PETRONAS to continue and expand its current vendor development programmes as well as to provide more opportunities for Sarawak companies to participate in the oil and gas sectors such as in the award of contracts for supply and services works

7. All these are undeniably the legitimate expectations of the people of Sarawak.  

8. I am pleased to say that these expectations are now embedded in the terms of the Commercial Settlement Agreement. Therefore, these expectations have been duly recognized by the Federal Government and PETRONAS.

9. Going forward, the State Government and PETRONAS have agreed to the establishment of a Consultative Framework to facilitate and monitor the implementation of the terms of the Agreement, to ensure that the interests of the State of Sarawak would be given the utmost consideration by PETRONAS in its decision-making process especially pertaining to the management of the offshore petroleum operations. Whilst PETROS will be given authority to manage and carry out onshore petroleum operations, PETRONAS will provide access to PETROS, data gathered from its past petroleum development efforts, so that the potentials of the petroleum resources could be realized.

10. The signing of this Commercial Settlement Agreement will herald the revival of onshore mining in Sarawak – the only place in Malaysia where upstream petroleum activities is taking place. The State Government has already issued to PETROS two (2) oil mining leases covering areas in Miri and near Marudi, to kickstart petroleum operation, and oil prospecting licenses will soon be issued to PETROS to facilitate exploration for more hydro carbons in areas described as the “petroleum fairway” in northern Sarawak.

11. The State Government will collaborate with PETRONAS to create and maintain a stable and investment friendly environment conducive for the sustainable development and growth of the oil and gas industry, both upstream and downstream, in Sarawak.

12. In conclusion, may I express the State Government’s appreciation to the Board and Management of PETRONAS for having agreed to the terms of this Commercial Settlement Agreement. This Agreement manifests common desire of both parties to cooperate constructively to bring the oil and gas industry in Sarawak to greater heights.
